Eligibility – Program Qualifications
  State government entities are eligible to receive state and federal surplus property. Eligibility documentation must include approved legislation, public decree, or public minutes establishing the entity. Contact Surplus Property at 404-657-8544 or surplusproperty@doas.ga.gov to determine if your agency is already enrolled. See the Surplus Property Manual, Chapter 5, for further information.

Service Charges
  Surplus Property does not receive any state or federal appropriations to operate. It is entirely self-funded through service charges for material disposed of through the program. Service charges may be paid using the state purchasing card (P-Card).

Property Restrictions
  There are restrictions on the use and disposal of any state or federal surplus property received through the program. Restrictions vary by the category of property received. The basic requirements are that the property must be put into use within one year and used for a minimum of one year from the in use date. During this period, the property may not be cannibalized, traded, sold or disposed of without written authorization from Surplus Property. Failure to comply with these restrictions may result in criminal prosecution. Please contact Surplus Property for guidance prior to disposing of surplus assets. Accessing Federal Surplus Property
  GSAxcessLink Opens in New Window is a web based program that allows eligible users to screen for military and civilian federal surplus property on-line. Surplus and excess property from these agencies may be viewed at http://gsaxcess.gov Access Code: 4757GA Password: GASURPLUS. See the Surplus Property Manual, Chapter 18, for further information.

Property Disposal
  Surplus Property offers a variety of disposal methods to redistribute and dispose of assets that are no longer needed by the state. The disposal process is designed to create an asset audit trail consistent with good accounting procedures. Only personnel authorized by the agency may sign a transfer form. All requests to dispose of state personal property must be submitted to Surplus Property utilizing the Transfer Form (below). See the Surplus Property Manual, Chapter 9, for details.

Transfer Forms may be used for different disposal options depending on the agency need. Forms must contain all applicable information and must be signed by an authorized agency representative. Forward completed forms to star@doas.ga.gov.

Onsite Disposal
  Asset disposals are conducted "onsite," meaning assets are managed in place rather than moved to a central location. Assets not redistributed are sold to the public through internet auctions. Agencies may have special disposal circumstances that are managed on an exception basis; contact Surplus Property for assistance. Disposal options are briefly described below. See the Surplus Property Manual, Chapter 8, for additional information.

Transfer
  Assets that are being moved between agencies require Surplus Property authorization. However, those moving within an agency do not. Since there may be funds involved in transactions between agencies, you may want to contact Surplus Property for assistance prior to submitting the request. See the Surplus Property Manual, Chapter 10, for details.

Direct Negotiated Sales
  Direct Negotiated Sales are used for redistribution from a state agency directly to an eligible donee (local government or non-profit). These transactions are encouraged as they have a direct benefit to local communities. Since there is always a charge for these assets, contact Surplus Property for pricing assistance. See the Surplus Property Manual, Chapter 10 for additional information.

Vendor Return
  The Georgia Procurement Manual (GPM) permits state agencies to trade-in assets in exchange for some concession when acquiring new, like items. Vendor Return transactions are authorized by Surplus Property and are encouraged as a cost-effective disposal method. When reviewing requests for Vendor Return, Surplus Property is looking for some advantage to the state. The advantage can be a discount on the new material, a cost avoidance on the disposal of the old asset, or any combination. See the Surplus Property Manual, Chapter 11, for details.

Destruction
  When assets are damaged and the repair is not feasible, inappropriate, or the cost exceeds the fair market value (FMV), they should be considered for destruction. Onsite destruction of property is frequently the most appropriate method of disposal. See the Surplus Property Manual, Chapter 13, for additional information.

All requests for destruction authorization must be received prior to destruction or disposal. Requests after-the-fact will not be authorized. Failure to comply with these restrictions could result in criminal prosecution.

Public Sales
  Assets not redistributed or destroyed are offered to the public through either internet auction or internet "buy it now" (fixed price) sale. They are offered for 3 to 5 business days and winning buyers will have up to 5 business days to pay for and remove the property. Agencies need to plan for this cycle when developing their disposal schedules. See the Surplus Property Manual, Chapter 12, for details.

Governing Legislation
 

The laws that govern Surplus Property are set forth in the Official Code of Georgia Annotated (O.C.G.A.).

The law restricts DOAS personnel and their family members from participating in surplus public sales. There are no restrictions on other government (state or local) employees. Sales to the public are conducted through commercial internet service providers.
