Governing Legislation
We are responsible for the disposal of the state’s surplus personal property. We also partner with the General Services Administration (GSA) to access federal government. surplus property.
Pertinent laws that govern state surplus property are set forth in the Official Code of Georgia Annotated (O.C.G.A.).
O.C.G.A. 50-5-140 through 50-5-146 restricts only DOAS personnel and their family members from participating in surplus public sales. There is no restriction on other state or local government employees.
Surplus Property does not receive any state or federal appropriations to operate. It is entirely self-funded through service charges for material received. Service charges are determined based on the quality, quantity and Fair Market Value (FMV) of the property received.
